This summary for SongbookFM is part of the full Terms and Conditions (T&C) of Zeneszöveg.hu Kft.; once the full document is published, the full document governs. Numbers in brackets point to the matching section of the T&C.

1. The Provider (T&C 1)

Zeneszöveg.hu Információszolgáltató és Kiadó Informatikai Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (Zeneszöveg.hu Kft.) · registered office: Homokos utca 47/B., 2049 Diósd, Hungary · company registration number: 13-09-211337 (Company Registry Court of the Budapest Környéki Törvényszék) · tax number: 22777306-2-13 · EU VAT number: HU22777306 · zeneszoveg@zeneszoveg.hu · +36 20 479 2949 · hosting: the Provider's own servers (Hungary). "SongbookFM" is a brand of the Provider, not a separate company.

2. What SongbookFM is (T&C C.1)

SongbookFM is a music streaming service: themed stations that play continuously. It is available:

  • on the songbook.fm landing page and in the app.songbook.fm web radio;
  • in the SongbookFM TV app (LG and Samsung smart TVs);
  • in the embedded player on zeneszoveg.hu pages and — with the Provider's permission — on other websites;
  • in the mobile app — once released.

3. Access levels, account (T&C 4, C.1, D)

  • Without signing in: the music starts straight away, to a limited extent; the app shows the current state of your allowance.
  • Registered, free: with a Songbook account, a daily listening allowance, a limited number of skips per hour and a curated part of the catalogue. The app shows the current state of your allowance.
  • Basic and Premium: paid tiers. Basic gives unlimited listening time; the exact content and price of each tier are shown at the point of purchase, where purchase is available. Subscriptions are governed by section 10 and Annex D of the T&C; for store purchases, cancellation and refunds follow the store's rules.

The Songbook account is shared: the same account works for SongbookFM and the Provider's other apps. An account may be created independently by a person aged 16 or over; under 16, the consent of a legal representative is required. The User must provide true data and is responsible for keeping their sign-in details secret.

Refusal of service (T&C 4.6). The Provider is under no obligation to contract: it may refuse registration, the use of SongbookFM or of a subscription, or its renewal, without giving reasons. Termination of a contract already concluded is governed by section 9.

4. TV app

  • The TV app is downloaded from the LG or Samsung store; the store's own terms also apply to the download.
  • The app works with an internet connection.
  • There is no sign-in on the TV: account features are available on songbook.fm (via the QR code shown on the TV).
  • How the TV app handles data: SongbookFM Privacy Notice, section 12.

5. Embedded player (T&C C.1a)

The Provider places the embedded player on its own pages (currently zeneszoveg.hu). The player and the lists may be embedded in a third party's website only with the Provider's permission. Permission is granted by individual agreement, or automatically when the website operator purchases the Provider's paid site licence (subscription); the content, scope and terms of the licence are shown in the purchase interface and become part of the contract upon purchase. Without permission, or after the permission expires or is withdrawn, the embedded player may stop working. The embedded player is provided by the Provider on other sites as well; without signing in, it can be listened to for a limited time.

6. Acceptable use (T&C 6, 8.3, 8.3a, C.2, C.3)

The music is for personal, private listening only. You may not:

  • play it in public places (shops, restaurants, events) without a separate business agreement;
  • record, download, redistribute or republish the stream;
  • circumvent the encryption, the playback keys or any other content protection;
  • request content in bulk with automated tools without a licence (automated access is possible only under a licence: by individual agreement or under the terms of paid automated access, T&C 8.3a);
  • circumvent the free allowance (for example by repeatedly clearing device data or using many devices in parallel);
  • engage in conduct that causes damage or legal liability to the Provider, another User or a third party.

The Provider may restrict unusual use and interrupt playback.

7. The music, intellectual property and the User's content (T&C 7, 8)

The recordings and compositions in the SongbookFM catalogue are owned by the Provider, or the Provider is entitled to use them. For as long as you use the service, you receive a non-exclusive, non-transferable right to listen for private purposes. All other rights are reserved by the Provider.

If you submit or publish content in SongbookFM, you alone are responsible for it, and you warrant that it does not infringe any law or the rights of any third party. The Provider is not obliged to check User content in advance (T&C 7.2). You shall compensate the Provider for damage and costs arising from your infringing content, your breach of the T&C or your unlawful conduct, including third-party claims and reasonable legal costs (T&C 7.7).

8. Availability, changes, liability (T&C 5.3, 5.4, 11)

  • The service is provided "as is". The Provider provides SongbookFM in its current state from time to time; it does not undertake continuous, error-free or time-specific availability. Because of maintenance, outages, attacks, the failure of a third party (for example a store or a network provider) or force majeure, the service may be suspended or operate in a limited way without prior notice.
  • Changes. The Provider may change the content, features, stations, free allowance and availability of SongbookFM; for free services, also without notice. The Provider notifies registered Users at least 15 days in advance of the complete discontinuation of SongbookFM; when a paid service is discontinued, it refunds the pro-rata fee for the unused period (for store subscriptions, the discontinuation takes effect at the end of the paid period).
  • Free use. No damages, compensation or credit are due for the suspension, restriction, change or discontinuation of the free service; the Provider's liability is limited to the exceptions below.
  • Paid use. You are entitled to your statutory rights (bringing the service into conformity, proportionate price reduction, termination; T&C 10.5). The Provider's aggregate liability — excluding the exceptions — does not exceed the fee paid for the service concerned in the 12 months preceding the event causing the damage.
  • The Provider is not liable for faults of your device, internet connection or software; for damage arising within your sphere (for example disclosing your sign-in details); for damage arising from circumstances beyond the Provider's control (force majeure); for third-party services (stores, external sign-in); or for lost profit, loss of data and indirect damage if it could not be foreseen when the contract was concluded.
  • Exceptions. The above do not limit the Provider's liability for breaches of contract caused intentionally or by gross negligence, or causing harm to human life, physical integrity or health, and do not affect the rights to which a consumer is mandatorily entitled by law.

9. Termination of the contract and the account (T&C 4.4, 4.5)

  • You can close your account at any time; you can request this at zeneszoveg@zeneszoveg.hu. Closing the account does not cancel a store subscription — that must be cancelled in the store.
  • Ordinary termination. The Provider may terminate the contract for the free service and the account without giving reasons, with 15 days' notice, by e-mail or in the app. During the notice period you may request a copy of your own data stored in your account.
  • Immediate suspension or termination. The Provider may suspend, restrict or terminate the account with immediate effect and without prior warning if you seriously or repeatedly breach the T&C; commit fraud, abuse, circumvention of payment or unauthorised automated access, or there is a well-founded suspicion of this; have provided false data; if a law or an authority's decision requires it; or if your conduct causes damage or may give rise to legal liability. In case of suspicion, the suspension lasts for the duration of the investigation. The Provider may close an account unused for 24 months after 30 days' prior notice.
  • Subscription. On ordinary termination, the Provider refunds the pro-rata fee for the unused period, or the termination takes effect at the end of the subscription period; on immediate termination, the fee paid is not refunded beyond the extent mandatorily required by law.
  • Statement of reasons, objection. If the reason for the restriction is illegal content or conduct, or content or conduct incompatible with the T&C, the Provider informs you by e-mail of the decision and a brief statement of its reasons, unless a law or an authority's decision prohibits this. You can object to the decision by e-mail and may go to court.
  • A User whose account has been terminated may not create a new account without the Provider's consent.
  • Own history. If the account ends other than at your request, your own history linked to the account (for example your listening history) is kept for the period stated in the privacy notice, so that it is available again if the account is reactivated.

10. Communication (T&C 13)

The Provider communicates with you electronically (at the e-mail address you provided, in the app, or by notice published on the interface); a notice sent by e-mail is deemed delivered on the working day following its sending. You are responsible for keeping your e-mail address valid and reachable.

11. Complaints and disputes (T&C 12, 15)

You can submit a complaint at zeneszoveg@zeneszoveg.hu, by post to the registered office or by phone; the Provider replies to a written complaint on the merits within 30 days. As a consumer, you may turn to the conciliation board competent for your place of residence or to the Pest County Conciliation Board (Pest Vármegyei Békéltető Testület; Balassi Bálint u. 25. IV. em. 2. ajtó, 1055 Budapest; phone: +36 1 792 7881; pmbekelteto@pmkik.hu; https://panaszrendezes.hu), or to a court. The contract is governed by Hungarian law; this does not deprive a consumer of the protection of the mandatory consumer protection rules of the country of their habitual residence.

12. Changes (T&C 14)

The Provider may amend these terms because of a change in law, a decision of an authority, a new or changed service, security or protection against abuse, or a change in the economic or technical conditions of the service. It publishes the amendment at least 15 days before it takes effect and notifies registered Users; if you do not accept it, you may terminate free of charge until it takes effect. An amendment required by a change in law or urgent security reasons may take effect immediately. For a paid service, the Provider gives 30 days' notice of an amendment that is disadvantageous to the consumer and more than minor, and the consumer may terminate free of charge within 30 days, with a pro-rata refund.
